Thakar Singh and Others vs State of Haryana and Others

M.M. Kumar, J.—This petition filed under Article 226 of the Constitution prays for issuance of a writ in the nature of mandamus directing the respondents to grant the arrears of revised pay scale w.e.f. 1.1.1996 to 1.4.1999 as the petitioners are entitled for the revision of pay scale for the aforesaid period as per Haryana Government notifications dated 7.1.2000 and 2.8.2004 (P-2 and P-3). A further prayer has been made for grant of revised family pension, gratuity as well as other consequential benefits w.e.f. 1.1.1996 along with interest at the rate of 18% p.a. from the date of notification till its actual payment.

For the relief claimed in the instant petition, the petitioners have also sent a legal notice, dated 12.4.2006 (P-4) to the respondents.

Without expressing opinion on merits as well as on the question of limitation, we deem it just and appropriate to direct the respondents to take cognizance of the legal notice, dated 12.4.2006 (P-4) sent by the petitioners and decide the same in accordance with law expeditiously preferably within a period of four months from the date a certified copy of this order is presented to them. It shall be appreciated if a speaking order is passed. This order, however, shall not extend the period of limitation, if any.

Petition stands disposed of in the above terms.
