This is an application filed by the applicant/private respondent praying for vacation of the interim order dated 10.08.2021.

Mr. S. Thoi Thoi, learned counsel appearing for the respondents submits that since the application has not been disposed of within 14(fourteen) days as provided under Art. 226(3) of the Constitution of India, the interim order passed by this Court shall stand automatically vacated.

However, it has been submitted by Ms. G. Pushpa, learned counsel for the petitioner that the 1st day on which a copy of the application has been served, will not be counted.

On perusal of the provisions of the Article 226(3) of the Constitution, the submission of Mr. S.Thoithoi, learned counsel appears to be prima facie correct. Ms. G. Pushpa, learned counsel for the applicant is granted some time to examine it and to show any judgment contrary to what has been submitted by Mr. S. Thoithoi.

List the matter on 17.09.2021.
