The petitioner temple has approached this court challenging Ext.P6 order of the 1st respondent whereby request of the petitioner in Ext.P3 for relaxation of the restrictions on the use of loudspeakers during the festival to be performed on 14th and 15th of February, 2024 has been rejected. According to the petitioner, Ext.P6 order has been passed without hearing the petitioner and without considering the contentions raised in Ext.P3.

On a perusal of Ext.P6 order, I find that the same has been passed without hearing the petitioner and without adverting to the contentions of the petitioner in Ext.P3.

Being passed in violation of the principles of natural justice, I set aside Ext.P6 order and direct the 1st respondent to consider Ext.P3 afresh after hearing the petitioner and in accordance with law. The petitioner shall appear before the 1st respondent before 5.30 pm today (12.02.2024) and the 1st respondent shall pass appropriate orders today itself. The petitioner shall produce a copy of this writ petition before the 1st respondent.

This writ petition is disposed of.
