Judgment
This writ petition is filed challenging the impugned Letter No DEE/I.S.D.No.3/HC/2022-23/04M dated 1.6.2022, whereunder the petitioner was directed to vacate the Quarter No AE/54 at Hill Colony Nagarjunasagar Dam, Nalgonda District.
In the earlier round of litigation, petitioner filed W.P.No.11590 of 2020, challenging the action of the respondents in seeking to evict the petitioner from the subject quarter. The said writ petition was disposed of by order dated 30.7.2020, directing the respondents not to disturb the petitioner from the subject quarter for a period of eight (8) weeks from the date of order. Further, the petitioner was directed to give an undertaking to the effect that he would vacate the quarter and hand over possession by clearing all the dues payable by him. As against the said order, W.A.No.431 of 2020 was filed and the same was also dismissed by order dated 2.3.2022.
The learned counsel for petitioner submits that the staff quarter is being allotted to an ineligible person i.e. 6th respondent, who is a ZPTC Member, Thipparthy, Nalgonda district.
However, in the opinion of this Court, the grievance of the petitioner was already redressed and negatived by this Court and the petitioner was directed to vacate the quarter. Insofar as the manner in which the staff quarter was allotted to an ineligible person i.e. 6th respondent herein is concerned, it cannot be adjudicated by this Court in the present writ petition as the petitioner has no locus-standi to question the same as he is not an aggrieved person. The petitioner was already transferred to another Division and in the earlier round of litigation, he was directed to vacate the quarter, which has become final. There are no merits in the writ petition and is liable to be dismissed.
Accordingly the writ petition is dismissed. However, petitioner is granted liberty to file application seeking extension of time for vacating the quarter, if so advised. The miscellaneous applications pending if any shall stand closed. There shall be no order as to costs.
