Judgment

The above writ petition is filed with following prayers:
“i. Issue a writ of mandamus or other appropriate writ, order or direction to the respondent to consider and dispose of Ext.P2 request submitted by the petitioner, by granting revision of timings in respect of petitioner’s stage carriage bearing No.KL-59/M 369 conducting service on the route Panathur – Kozhikode, forthwith, in the interest of justice.
ii. grant the petitioner such other reliefs which this Hon’ble Court deem just and fit in the circumstances of the case.” (sic)
The petitioner is an existing stage carriage operator conducting service on the route Panathur – Kozhikode and the permit issued to stage carriage bearing No.KL-59/M-369. According to the petitioner, the running time of the petitioner’s service is 1.30 minutes per kilometer. On account of traffic block, it is submitted that the petitioner is not in a position to conduct service adhering to the timings. It is the case of the petitioner that there is circumstances warranting for revision of timing under Rule 145 of the Kerala Motor Vehicles Rules. The petitioner submitted Ext.P2 application for revision of timing. No orders are passed so far. Hence this writ petition is filed.
Heard the counsel for the petitioner and the Government Pleader.
After hearing both sides, I think this writ petition itself can be disposed of directing the respondent to consider Ext.P2, as expeditiously as possible, and also in accordance to seniority.
Therefore, this writ petition is disposed of directing the respondent to consider Ext.P2 request submitted by the petitioner, for granting revision of timings in respect of petitioner’s stage carriage bearing No.KL-59/M-369 conducting service on the route Panathur – Kozhikode,as expeditiously as possible, and also in accordance to seniority.
