The  petitioner  has  been  disqualified  from  the  post  of  Sub-Inspector in Delhi Police and Central Armed Police Forces “CAPFs” on the ground that he suffers from a left-sided Deviated Nasal Septum “DNS”. There are concurrent findings by the Detailed Medical Examination “DME” and Review Medical Examination to the effect that the petitioner has left-sided DNS.

Mr. Ajay Veer Singh, learned Counsel for the petitioner has drawn our attention to the instructions issued by the Ministry of Home Affairs “MHA”  with respect to the medical standards for recruitment to the Delhi Police and CAPFs. They state inter alia that patients who are suffering from “mild and moderate DNS with both nasal airways” may not be rejected.

He points out that the DME and RME reports do not categorise the DNS from which his client is suffering as to whether it is mild, moderate or otherwise.

Mr. Singh further submits that DNS is a curable affliction and that the petitioner has undergone a surgery after which he does not suffer from the said disability any more.

Prima facie, in these circumstances, it would appear appropriate that the petitioner be re-examined for assessing whether he still suffers from DNS.

In these circumstances, Dr. Geetanjali Sharma, learned Sr. CGSC, on instructions, is agreeable to the petitioner being re-examined by an ENT specialist in the Army Research and Referral Hospital, New Delhi “R&R Hospital”. This suggestion is also agreeable to Mr. Singh, learned Counsel for the petitioner.

Accordingly, we dispose of this writ petition with a direction that the petitioner be re-examined by a concerned ENT specialist in the  Army  R&R  Hospital  for  which  purpose,  the  petitioner  would present himself in the office of the Medical Superintendent of the R&R Hospital at 11.00 am on 1 November 2025. The Medical Superintendent would ensure that a competent ENT specialist examines the petitioner and opines as to whether he is still suffering from DNS and, if so, whether the DNS would be an impediment in his recruitment for the post of Sub-Inspector in the Delhi Police and CAPFs, keeping in mind the applicable guidelines.

The petition stands disposed of in the aforesaid terms.

Dr. Geetanjali Sharma undertakes to communicate this order to Army R&R Hospital.

Needless to say, in case the petitioner is found not to suffer from DNS, further proceedings with respect to his result and selection would follow.
