Ram Mohan Reddy, J.—Petitioner''s appointment as a Lecturer in Mathematics in the 4th respondent private Education. Society, admitted to Grant-in-Aid, by an approval of the 1st respondent-Department of Education, aggrieved by the non-consideration of his representation for service benefits from the date of initial appointment i.e., 25.08.1990 and not from the date of approval i.e., 24.03.1999 with aid, has presented this petition for a writ of mandamus. Learned Government Advocate when directed to take notice for respondent Nos. 1 to 3 State and its Department of Education, submits that in the light of the decision of the learned Single Judge in W.P. No. 19431/2005 and connected petitions in V.T.S. Jeyabal v. State of Karnataka & Others D.D. 13/10/2006 reckoning the service of teachers from the date of initial appointment in the private Educational Institution instead of the date of admission of the institution to Grant-in-Aid or the date of approval of appointment of the teachers, for the purpose of fixation of pay scales, seniority and all consequential benefits, respondents 1 to 3 would consider the petitioner''s request and pass orders entitling the petitioner to all service benefits on verification of the records.

Petition is accordingly allowed.
