Notice. Ms. Seema Sharma, learned Deputy Advocate General, appears and waives service of notice on behalf of the respondents.
Heard.
The petitioner is a Language Teacher presently serving at GSSS Sharli, Tehsil Kamrou, District Sirmour. Her husband is also a Trained Graduate Teacher (Non-Medical). He is stated to be serving at GSSS Jamniwala, Tehsil Paonta Sahib, District Sirmour. Petitioner’s case is that on completion of the normal tenure at her present place of posting, she made a representation to the respondents to transfer her in view of the couple concession available under Clause 5.4 of the transfer policy. Grievance of the petitioner is that her such representation dated 03.07.2023 has not been adjudicated by the competent authority. Learned counsel for the petitioner submits that the petitioner would be content in case she is permitted to make a fresh representation to respondent No.2 and directions are issued to decide the same within a fixed time schedule.
In view of the above submissions, this writ petition is disposed of by permitting the petitioner to make a fresh representation to respondent No.2 within a week from today, which shall be considered and decided by respondent No.2/competent authority in accordance with law and applicable policy, within a period of three weeks thereafter. The decision so arrived at shall also be communicated to the petitioner.
The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.
