Judgment
Arindam Sinha, J
Mr. Swain, learned advocate appears on behalf of petitioner and hands up memo of date saying his client does not want to proceed with the matter and it should be withdrawn.
Mr. Sharma, learned advocate, Additional Government Advocate appears on behalf of State and submits, he has not yet received instruction with regard to record in order dated 17th February, 2023 and adjournment granted thereby for State to enquire and report on the proof submitted by opposite party no.4 and acted upon, to issue impugned legal heir certificate.
Mr. Bhoi, learned advocate files power and submits, he is appearing on behalf of opposite party no.4.
The writ petition was moved before this Bench on 7th December, 2022, taken up thereafter, inter alia, on 5th January, 2023 and 17th February, 2023. Orders were made on those dates and as aforesaid adjournment granted to State for enquiry and report. In the circumstances and petitioner’s prayer for not wanting to proceed, the writ petition is dismissed.
