Judgment
Learned counsel for the parties have fairly stated before this Court that the controversy involved in the present case stands concluded on account of judgment delivered by this Court in the case of Bhumi Mawaliya and others Vs. State of M.P. and Others in W.P. No. 17444/2017. The order dated 13.05.2019 reads under:

The petitioners before this Court have filed this present petition being aggrieved by the order dated 25.09.2017 and the order dated 18.01.2017 (Annexure P-1 and P-2) passed by the Collector, Indore. The petitioners' contention is that an advertisement was issued on 25.09.2017 by the Collector, Indore inviting applications for the posts of Assistant Grade-III/Data Entry Operator. As per the advertisement, following qualifications are the mandatory qualifications:-

कार्यालय सहायक सह-डाटाएन्ट्री (संविदा) के 10 पदों की नियुक्ति एक वर्ष तक के लिए वेद्य होगी।
वर्षान्त पर कार्य का वार्षिक मूल्यांकन किया जायेगा। मूल्यांकन आधार पर उपयुक्त होने पर एक वर्ष के लिए पुनः सेवावृ़द्ध पर विचार किया जायेगा।
इस संविदा नियुक्ति के आधार पर नियमितिकरण संबंधी कोई मांग या दावा नहीं किया जायेगा।
पात्र आवेदकों की सूची को सी.पी.सी.टी. स्कोर कार्ड में प्राप्त अंकों के आधार पर प्रक्रिया अनुसार मेरिट सूची तैयार की जावेगी। सीपीसीटी के स्कोर कार्ड में दो सेक्शन होते है, प्रथम सेक्शन कम्प्यूटर प्रोफिशिएन्सी एवं दूसरा सेक्शन नेट टाइपिंग(हिन्दी एवं अंग्रेजी) स्पीड को होता है। नेट टाईपिंग स्पीड के लिये हिन्दी और अंग्रेजी दोनों में डाटाएन्ट्री आपरेटर के लिये क्वालिफाईड होना आवश्यक होगा। हिन्दी एवं अंग्रेजी नेट टाईपिंग स्वीड में क्वालिफाईड होने की स्थिति में मेरिट का निर्धारण कम्प्यूटर प्रोफिशिएन्सी (CPCT ) में प्राप्त अंकों के आधार पर किया जावेगा लेकिन मेंरिट के निर्धारण में केवल उन्हीं अभ्यर्थियों को शामिल किया जायेगा, जिन्होंने हिन्दी एवं अंग्रेजी नेट टाईपिंग में क्वालिफाई किया हो।
यदि दो या अधिक आवेदकों के कम्प्यूटर प्रोफिशिऐन्सी (CPCT ) में समान अंक होगें तो हिन्दी टाइपिंग के अंको के आधार पर मेंरिट का निर्धारण होगा।
हिन्दी टाईपिंग में समान अंक होने पर अंग्रेजी टाईपिंग के अंकों के आधार पर मेरिट का निर्धारण किया जावेगा।
मेरिट में दो आवेदकों को कम्प्यूटर प्रोफिशिऐन्सी, हिन्दी एवं अंग्रेजी नेट टाईपिंग सभी में समान
अंक होने पर अधिक आयु वाले आवेदक को प्राथमिकता होगी।
उपरोक्त तालिका में दर्शित पदों की नियुक्ति हेतु दिनांक 29.09.2017 से 30.10. 2017 तक ऑन लाईन प्रक्रिया के तहत www.mponline.gov.in पर पोर्टल शुल्क 70/- रूपये प्रति अभ्यर्थी निर्धारित है।

The aforesaid advertisement has also made it clear that Computer Proficiency Certification Test (CPCT) is a mandatory qualification. The petitioners' grievance is that as per clause 4 of the advertisement, a candidate is required to pass CPCT examination in Hindi as well as in English.
The petitioner, who is appearing in person before this Court has drawn attention of this Court towards the recruitment Rules known as M.P. Junior Service (Joint Qualifying Examination) Rules, 2013. The aforesaid Rules do not provide for such a qualification. The qualification regarding CPCT was introduced by an executive instruction issued by the General Administration Department dated 26.02.2015 and the same reads as under:-
समूह चार -(क) अभ्यभिर्थयों ने हायर सेकेण्डरी परीक्षा (10+2) उत्तीर्ण की हो तथा उनके पास मान्यता प्राप्त विश्वविद्यालय से कम्प्यूटर एप्लीकेशन में पत्रोपधि/प्रमाण पत्र हो, साथ ही कम्प्यूटर पर 30 शब्द प्रति मिनिट की गति से शासन द्वारा अधिकृत संस्था से प्राप्त हिन्दी में टायपिंग की उक्षता प्रमाण पत्र होआशुलिपिक के लिए अभ्यर्थी ने किसी मान्यता प्राप्त संस्था अथवा परिषद् से अंग्रेजी अथवा हिन्दी शीघ्रलेखन परीक्षा 100 शब्द प्रति मिनिट की गति से उत्तीर्ण की हो और स्टेनोटायपिस्ट के लिये अभ्यर्थी के पास सामान्य प्रशासन विभाग द्वारा समय-समय पर यथा मान्य अंग्रेजी अथवा हिन्दी शीघ्रलेखन में 80 शब्द प्रति मिनिट की गति हो
A controversy arose whether a candidate is required to qualify English typing as well as Hindi typing in CPCT test and a circular was issued on 18.08.2017 again by the General Administration Department wherein it was stated that a candidate is required to pass Hindi as well as English typing while qualifying CPCT test. There were a large number of candidates, who have not qualified English typing examination as per CPCT test and the candidates of State of Madhya Pradesh being Hindi speaking State have been denied the opportunity of employment on account of aforesaid circular and the State Government thereafter, on 04.07.2018 again clarified the entire issue and the latest clarificatory circular dated 04.07.2018 issued by the General Administration Department reads as under:-

सन्दर्भित परिपत्र दिनांक 24.01.2017 द्वारा कम्प्यूटर दक्षता प्रमाणीकरण परीक्षा (COMPUTER PROFICIENCY CERTIFICATION TESTCPCT) में इंगलिश टायपिंग की न्यूनतम गति 30 शब्द प्रति मिनिट एवं हिन्दी टायपिंग की न्यूनतम गति 20 शब्द प्रति मिनिट निर्धारित की गई है।
उक्त निर्देशो से यह भ्रम की स्थिति उत्पन्न हो रही है कि सहायक ग्रेड-3 अथवा समकक्ष पदों के लिए CPCT में अंग्रेजी एवं हिन्दी टायपिंग में फनंसपपिमक होना आवश्यक है। इस संबंध में स्पष्ट किया जाता है कि राज्य सरकार द्वारा सहायक ग्रेड-3 एवं समकक्ष पदों के लिए हिन्दी टायपिंग अनिवार्य किया गया है, किन्तु अंग्रेजी टायपिंग नहीं। इसलिए सहायक ग्रेड-3 अथवा समकक्ष पदों के लिए CPCT परीक्षा में हिन्दी टायपिंग उर्त्तीर्ण होना अनिवार्य है अंग्रेजी नहीं। इसलिए यदि CPCT परीक्षा में कोई अभ्यर्थी अंग्रेजी टायपिंग में Not Qualified रहता है तो वह राज्य शासन में सहायक ग्रेड-3 व अन्य समकक्ष पर के लिए अनर्ह नहीं होगा, जो अभ्यर्थी अंग्रेजी टायपिंग में Qualified है तो उसे अतिरिक्त योग्यता में माना जा सकता है। किन्तु यदि किसी पर के लिए अंग्रेजी टायपिंग आवश्यक है तो उसके लिए अंग्रेजी कम्प्युटर टायपिग की अनिवार्यता रहेगी।

The aforesaid executive instruction makes it very clear that it is not at all mandatory for a post that a candidate should have qualified English typing as well as Hindi typing. It was further clarified that in respect of only those specific posts where recruitment rules provide English typing also as a compulsory and essential qualification, the employer can make it a mandatory qualification.
It was also clarified that for qualifying the CPCT test, a candidate is not required to qualify English typing as well as Hindi typing.
The petitioners before this Court have certainly passed the CPCT examination. They have qualified Hindi typing also. The only problem is that some of them have not qualified English typing. No provisions of law has been brought to the notice of this Court by the State Government to establish that under the recruitment rules framed by His Excellency the Governor by virtue of proviso to Article 309, English typing is the compulsory qualification for the post in question and therefore, in absence of such a mandatory qualification, once the petitioners have qualified the CPCT examination and they have qualified the computer proficiency examination also, the question of denying them their legitimate right of consideration is certainly violative of the constitutional right guaranteed to them under the Constitution of India.
It is again clarified that no provision of the recruitment rules has been brought to the notice of this Court makes English typing compulsory for the post in question. Resultantly, writ petition is allowed and the respondents are directed to prepare the merit list by taking into account the CPCT certificate submitted by the petitioners. The respondents will not deny the petitioners' appointment, in case, they find place in the merit list only on the ground that they have not qualified English typing examination. With the aforesaid, writ petition is allowed. The exercise of preparing merit list be concluded within 30 days. The respondents thereafter, shall be free to take appropriate consequential steps in accordance with law.
The aforesaid judgment dated 13.05.2019 passed in W.P. No. 1744/2017(supra) shall be applicable mutatis mutandis to the present case and the impugned order dated 14.07.2017 Annexure P-1 is set aside. Petitioners shall be entitle for all consequential benefits.The aforesaid exercise shall be completed within sixty days.
With the aforesaid, the present petition stands disposed of.
