Judgment
Prafulla C. Pant, J.—Heard.
Applicants Vidyaram Joshi and Shashi, who are in jail in connection with F.I.R. No. 135 of 2011, relating to offence punishable u/s 304B I.P.C. and one punishable u/s 3/4 Dowry Prohibition Act, 1961, Police Station- Bazpur, District Udham Singh Nagar have sought their release on bail.
Applicant No. 1 Vidyaram Joshi, is farther-in-law and applicant No. 2 Shashi is mother-in-law of the deceased. A 41/2 months infant female child of the deceased is said to be with applicant No. 2 in jail. Learned Counsel for the applicant drew attention of this Court to the fact that after the applicants'' daughter-in-law suffered burn injuries on 05.06.2011, she was taken to hospital, where she succumbed to injuries. It is further pointed out that it is shocking that after the arrest of the husband of the deceased, the brothers of the deceased, in retaliation came to the house of the applicants, and set their minor daughter aged 15 years on fire, on 08.06.2011, who is also said to have been succumbed to the injuries.
In the above circumstances, without expressing any opinion, as to the final merits of the case, this Court is of the view that applicants deserve bail.
The bail application is allowed.
Let the applicants Vidyaram Joshi and Shashi, be released on bail on executing personal bond by each one of them and furnishing two sureties for each one them, each of the like amount, to the satisfaction of Additional Chief Judicial Magistrate, Kashipur.
