Vijay Krishna Tripathi and Ors. vs State of U.P.& Ors.

R. K. Agarwal, J.—The contention of the petitioners is that they are employees and Teachers of U.P. State Cement Corporation Inter College, Dala, Sonebhadra. The College is run by the U.P. State Cement Corporation and their salary is to be paid under the provisions of Payment of Salaries Act, 1971. In spite of making the payment under aforesaid provisions the State Government is providing Annual grant. Employees and Teachers of Cement Factory Inter College, Churk, Distt. Sonebhadra which is also run by the U.P. State Cement Corpn., approached this Court by filing Civil Misc. Writ Petition No. 32180 of 1995, Chandrika Pd. Gupta and others v. State and others, which was decided on 14101999. This Court allowed the writ petition with certain directions.

Heard Shri Ashok Bhushan learned Counsel for the petitioners and Shri Hyder Hussain, learned Standing Counsel who represents the Respondent Nos. 1 to 4 and Shri S.N. Singh, Advocate who represents the Respondent Nos. 5 to 6.

The controversy involved in the present writ petition is squarely covered by the decision of this Court in the case of Shri Chandrika Pd. Gupta (supra). The direction given in the aforesaid case will apply in the present case also. With aforesaid observation the writ petition stands allowed.
