Since learned Counsel for the petitioners and learned APP for State are present today, with their consent, the matters have been taken up today itself.

The applications are allowed.

The next date of 03.07.2026 stands cancelled.

Both these petitions, being connected, have been taken up together.

There are two cross FIRs.

Crl. M.C. 1525/2025 relates to first FIR i.e. FIR No.281/2024 dated 09.07.2024 is for commission of offences under Sections 74/75/79/126(2)/3(5)/351(2) of BNS (corresponding Sections 354/354A/509/341/34/506 IPC) and Section 12 Protection of Children from Sexual Offences (POCSO) Act, 2012 registered at P.S. Seelampur. Such FIR No.281/2024 is against accused-Vijay Priya Gautam and accused-Annu Bala and as per allegations made by father of child-victim, the accused were talking to his daughter (then aged 15 years) indecently and had made indecent gestures and one of the accused had even tried to pull her inside.

The other petition Crl. M.C. 1553/2025 relates to second FIR i.e. FIR No.283/2024 which is also dated 09.07.2024 and is for commission of offences under Section 74/75/76/79/126(2)/3(5) of BNS (corresponding Sections 354/354A/509/341/34 IPC) & 3(1)(r)(s)(w)(i)(ii) of The Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, registered at P.S. Seelampur. As per the averments made in said FIR, which has been registered on the basis of complaint made by accused in the cross-case, casteist remarks were made and one of the accused had caught hold of her hand and snatched her dupatta.

Charge-sheet in both the matters have been filed and with respect to FIR No. 281/2024, charges have been framed and the case is at the stage of prosecution evidence whereas in the cross-case, the charges are yet to be ascertained.

Fact, however, remains that both the parties have entered into settlement and compromise deeds dated 20.08.2025 have been placed on record in both the matters.

The dispute is, essentially, between the two neighbours who are residing in a same building, albeit, at different floors. It is submitted that a meeting was convened on 08.01.2025 in which several respectable persons of the society participated and, consequent to their efforts, both the parties expressed their remorse towards the incidents in question and undertook that they would live peacefully in the Society and would not create any problem for anyone.

It is informed that that in terms of the abovesaid settlement, both the parties are living happily and peacefully and in a very friendly atmosphere and, therefore, respondent No.2 in both the matters pray that they are not interested in continuing with the abovesaid respective FIRs and would have'no objection'if both the FIRs are quashed. The child victim in case FIR No. 281/2024 has joined the proceedings through video conferencing and she also reiterates that matter has been amicably settled and she and her parents do not want any action.

Both the sides submit that they have settled the matter voluntarily.

Keeping in mind the aforesaid and in order to facilitate both the sides in maintaining and restoring cordiality, the proceedings deserve to be quashed.

Accordingly, exercising inherent powers vested in this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, it is deemed appropriate to quash both the FIR.

Consequently, to secure the ends of justice, FIR No.281/2024 dated 09.07.2024 for commission of offences under Sections 74/75/79/126(2)/3(5)/351(2) of BNS (corresponding Sections 354/354A/509/341/34/506 IPC) and Section 12 Protection of Children from Sexual Offences (POCSO) Act, 2012 and FIR No.283/2024 also dated 09.07.2024 for commission of offences under Section 74/75/76/79/126(2)/3(5) of BNS (corresponding Sections 354/354A/509/341/34 IPC) & 3(1)(r)(s)(w)(i)(ii) of The Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, both registered at P.S. Seelampur, along with all consequential proceedings arising therefrom, stand quashed.

Original Compromise Deed and original affidavits of parties, copies of which have been filed with the present petition, shall be submitted to learned Trial Court within four weeks from today.

The petitions stand disposed of in aforesaid terms.
