This sixth application has been filed by the applicant under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of temporary bail in connection with Crime No.215/2017 registered at Police Station - Agar, District Agar Malwa(M.P.) for offence punishable under Section(s) 420, 471, 468, 467 and 406 of IPC. Applicant is in judicial custody since 24.02.2018 to 13.01.2020 and thereafter since 15.06.2024. His first application has been dismissed vide order dated 14.11.2018, passed in M.Cr.C. No.37018/2018. His second bail application - M.Cr.C. No.20290/2019 has been dismissed as withdrawn vide order dated 26.06.2019 with a direction to the trial Court to conclude the trial as expeditiously as possible, preferably within a period of six months. His third application - M.Cr.C. No. 53505/2019 has been allowed vide order dated 13.01.2020 with a direction. His fourth application - M.Cr.C. No.46818/2014 has been dismissed vide order dated 14.05.2025.

His fifth application - M.Cr.C. No.39119/2025 has been dismissed as withdrawn vide order dated 04.12.2025.

Learned Counsel for the applicant contends that mother of applicant Resham Bai expired on 28.11.2025. The death certificate and Shok Patrika are annexed with the application. ). Presence of applicant is required for performing the rituals on demise of his mother, which are going to be held on 08.12.2025 to 09.12.2025. Therefore, applicant may be extended benefit of temporary bail to perform the rituals on demise of his mother.

Per contra, learned Counsel for the respondent/State opposes the bail application and prays for its rejection on the ground of gravity of offence.

Heard learned counsel for the parties. Perused the affidavit and documents filed with the application.

Considering the aforesaid and in view of the allegations, this application for temporary bail is allowed and it is hereby directed that the applicant - Vikram Singh shall be released on temporary bail for a period of seven d a y s from the date of his release, subject to depositing cash security Rs.50,000/-(Rupees Fifty Thousand Only) and furnishing personal bond of Rs.2,00,000/-(Rupees Two Lacs Only) with one solvent surety of same amount to the satisfaction of trial Court. He shall also comply with the conditions enumerated under Section 437(3) of Cr.P.C. The applicant shall surrender before the trial Court on or before expiry of period of seven days. Necessary papers regarding surrender of the applicant be furnished to this Court. In case of failure to comply the order within 3 days, this bail order shall automatically stand cancelled. The cash surety shall be returnable after surrender into custody. In case of any violation of above conditions, the order shall stand cancelled and the security and surety amount shall be forfeited.

This temporary bail application filed under Section 483 of BNSS, 2023 stands disposed of.
