Heard the learned counsel for the petitioners, the learned counsel appearing on behalf of the respondent State and the learned counsels appearing on behalf of the private respondents.

The grievance of the petitioners in the present petition is that the juniors to them have been promoted to the higher post.

On 18.09.2020 notices were issued upon the private respondents and pursuant to that, the learned counsels on behalf of the private respondents have appeared and they have filed the counter affidavit and the State has also filed the counter affidavit.

Mr. Sahani, the learned counsel appearing on behalf of the petitioners submits that now the Government of Jharkhand has come out with the Notification No.3463 dated 03.06.2022 and in view of that, the case of the petitioners is required to be considered afresh by the respondent-Government of Jharkhand, and in view of that, this petition may be disposed of for fresh consideration by the Government of Jharkhand.

The learned counsels appearing on behalf of the respondent State as well as the private respondents have got no objection if this petition is being disposed of without entering into the merits of the case and for considering the case in view of the new Notification Dated 03.06.2022.

In view of the above submission of the learned counsels appearing for the parties, without entering into the merits of the present case, this petition is being disposed of with liberty to the petitioners to file a fresh representation before the respondent Government of Jharkhand and the same shall be decided in accordance with the rules, regulations and the precedents which is applicable for promotion in the Government of Jharkhand.

This petition is disposed of, accordingly.

It is expected that the said decision shall be taken within three months considering that some of the petitioners as well as the private respondents have already retired.

Pending petition if any also stands disposed of accordingly.
