Vinod Kumar Sharma vs State of H.P and Others

Justice Kurian Joseph, C.J.—The writ petitions are filed with the following prayers:

(i) Writ in the nature of mandamus may kindly be issued, directing the respondents to grant the benefit of seniority, pay fixation and counting of the service rendered by the petitioner on ad-hoc basis for the purpose of pension w.e.f. 7.4.1986 to 18.11.1996 (6.1.1990 to 5.5.1999 in CWP No. 10221/2011) i.e. the due date in favour of the petitioner as has been allowed to similarly placed persons in the department of Education, Government of Himachal Pradesh along with consequential benefit.

It is submitted that the issue is covered by the judgment of this Court in Paras Ram vs. State of H.P., CWP (T) No. 7712 of 2008 decided on 19.5.2009 (Latest HLJ 2009 (HP) 887), which has been implemented also. If that be so, there is no point in discriminating the petitioners in case the petitioners are similarly situated as the petitioner covered by the judgment, referred to above. Accordingly, this writ petition is disposed of as follows:

In the event of the petitioners filing representation(s) within a period of one month from today before the first respondent, the said respondent will consider the same in the light of the judgment, referred to above and in case the petitioners are similarly situated as the petitioner in the judgment referred to above, the petitioners herein also shall be entitled to all the consequential benefits. The needful in this regard and also disbursing the benefits shall be done within a period of four months from the date of production of a copy of this judgment along with a copy of the writ petition and the copy of the judgment referred to above by the petitioner concerned.

The writ petitions are disposed of, so also the pending applications, if any.
