Judgment
Basant Balaji, J
The petitioner is the contesting candidate for the election to the Managing Committee of Kerala State Co-operative Housing Federation Ltd. No.4330. The election is scheduled to take place on 16.12.2023 in the office of the Apex Society at Kaloor within the jurisdiction of Kasaba Police Station. Ext.P1 is the notification issued by the Election Commission. Exts.P2 is the voters’ list, and P3 is the notice with name of the candidates.
The petitioner has approached this court seeking the following prayers:
i. To issue a writ of mandamus or any other appropriate writ order or direction to respondents 1 to 3 to afford adequate and effective police protection for the smooth conduct of poll on 16.12.2023 in the process of election to the managing committee of 7th respondent so as to ensure the protection of life of petitioner and other contesting candidates in his panel as well as their supporters and to have hindrance free access to the polling station by the delegates of primary societies,
ii.To issue a writ of mandamus or any other appropriate writ order or direction to 6th respondent to videograph the entire proceedings of poll scheduled on 16.12.2023 at the expense of petitioner.
iii.Considering the exigencies and necessity for urgent consideration of the grievance voiced in this Writ Petition (C), production of English translations of documents in vernacular, may kindly be dispensed with for the time being;
iv Such other reliefs which this Hon’ble Court may deem fit and proper in the interest of justice.
Learned Government Pleader on instructions submits that sufficient police will be deployed for the smooth conduct of the election to be scheduled on 16.12.2023 to the Managing Committee of Kerala State Co-operative Housing Federation Ltd. No.4330.
Accordingly, the writ petition is disposed of directing respondents 1 to 3 to deploy sufficient police force for the smooth conduct of the polling and counting to the Managing Committee of Kerala State Co-operative Housing Federation Ltd. No.4330. As far as the video graphing of the polling and counting is concerned, the petitioner shall file a petition before the returning officer who shall allow the video graphing of the polling and counting without hindering the secrecy of the polling at the expense of the petitioner.
The writ petition is disposed of.
