The petitioner through instant petition under Article 226 of the Constitution of India is seeking directions to respondents to grant relaxation for applying against the advertised post of Constable.
The respondent vide Advertisement No.1 of 2026 dated 01.01.2026 invited applications for the post of Constable. The petitioner applied for the said post but his application was not accepted by the online portal on account of being overage. He had earlier applied for post under Advertisement No.14 of 2024 but said advertisement was withdrawn by the respondent on 02.07.2025. The withdrawal notice provided that the candidates eligible under the already issued advertisement would be considered eligible against re-advertised posts. Advertisement No.14 of 2024 which was withdrawn by the respondent provided for 3 years age relaxation which has not been provided in the current advertisement. This is second round of litigation. On the earlier occasion, the petitioner along with other candidates preferred CWP NO.1944 OF 2026 before this Court which was disposed of vide order dated 23.01.2026 with a direction to respondent to pass a reasoned order with respect to his claim and communicate to him by 27.01.2026.
Learned counsel for the petitioner submits that respondent did not pass order pursuant to directions of this Court, however, pursuant to order dated 31.01.2026 of this Court, petitioner was permitted to file application manually.
Learned State counsel, on instructions from concerned Law Officer, Haryana Staff State Commission, concedes that pursuant to order dated 23.01.2026 passed in CWP NO.1944 OF 2026, the respondent has not passed and communicated reasoned order to the petitioner.
The petitioner pursuant to order of this Court has been permitted to file application form manually. Now, he would be able to participate in the selection process.
In the backdrop, the petition, at this stage, deserves to be disposed of without further order, however, with liberty to parties to avail remedy in accordance with law if cause survives or fresh cause of action arises.
