Heard Mr. N. Ibotombi, learned senior counsel assisted by Mrs. N. Savitri, learned counsel appearing for the petitioners, Mr. S. Nepolean, learned GA appearing for the respondents and Mr. M. Hemchandra, learned senior counsel assisted by Mr. Th. Rohitkumar, learned counsel appearing for the Caveator.

After hearing the rival submissions advanced by the learned counsel appearing for the parties and on careful perusal of the record, this court is of the considered view that the present writ petition can be disposed of at the Motion stage itself by issuing the following directions:-

(i) If the Government took up process for giving promotion to the post of Graduate Teachers (Science/ Arts/ Home Science and Hindi) in the Department of Education (S), Government Manipur, the said promotion should be done strictly in terms of the relevant recruitment rules and other applicable rules and also, strictly on the basis of the Final Seniority List of Under Matric/Matriculate/ Under Graduate/ Primary/ Hindi Primary/ Hindi Matriculate Teacher (both original and converted group) as published by the Director of Education (S), Manipur on 13-06-2022.

(ii) It is also made clear that at the time of consideration of the promotion, the authorities should not solely act on the eligibility list published by the Director (S), Manipur as notified under the Notification dated 25-11-2022 and the authorities should strictly adhere to the aforesaid Final Seniority List.

With the aforesaid directions, the present writ petition is disposed of.
