The petitioner has submitted Ext.P8 application before the respondent on 05.02.2021 for correction of date of birth in the passport on the basis of
Ext.P7 decree in O.S.No.511/2009 on the files of the Munsiffs Court, Kodungallur, dated 20.01.2020. Ext.P10 is the judgment in O.S.No.511/2009.
The grievance of the petitioner is that, the respondent is refusing to act upon Ext.P10 judgment and Ext.P7 decree in O.S.No.511/2009 and to correct
the entry regarding the date of birth in the passport.
The respondent has filed a statement relying on O.Ms issued in the matter of correction of date of birth in the passport. It is stated in the counter
affidavit that, only if the request for correction of date of birth is found to be genuine, the application can be entertained and corrected. The petitioner
has produced the judgment in O.S.No.511/2009 as Ext.P10 along with reply affidavit, whereby the Court has declared that the correct date of birth of
the petitioner is 27.05.1965. The petitioner has also given his explanation for not preferring the application for correction of date of birth immediately
after Ext.P10 judgment.
Heard the learned Counsel for the petitioner and Smt.Krishna, the learned CGSC for the respondent.
There will be a direction to the respondent to consider Ext.P8 application for correction of date of birth on the basis of Ext.P10 judgment and
Ext.P7 decree and on the basis of the O.Ms issued in this regard and after examining the genuineness of the claim made by the petitioner. This shall
be done within a period of one month from the date of receipt of a copy of this judgment. The petitioner is also free to place additional materials
before the respondent for consideration of Ext.P8.
The writ petition is disposed of with the above directions.
