The petitioner is the holder of an Indian passport bearing No.K9220279, which is having a validity till 27.01.2023. According to the petitioner, the actual date of birth of the petitioner is 10.05.1963. However, the date of birth entered in the passport is 01.01.1958. The petitioner has submitted Ext.P3 application for correction of date of birth in Ext.P1 passport. The grievance of the petitioner is that the application for correction of date of birth in the passport is not so far considered by the 2nd respondent.
Heard the learned Counsel for the petitioner and Smt.S.Krishna, learned CGSC for the respondents.
Smt.S.Krishna, learned CGSC submits that Ext.P3 application of the petitioner is not in the prescribed format and if the petitioner submits an application in the prescribed format, the same can be considered.
The learned Counsel for the petitioner submits that the petitioner will submit an application for date of birth correction on Ext.P1 passport in the prescribed format, online.
In such circumstances, if the petitioner makes a fresh application for correction of date of birth in prescribed format, the respondent shall consider the same, within a period of one month from the date of receipt of such application, in accordance with O.M.VI/401/2/5/2001 dated 22.09.2016 and in accordance with law.
The writ petition is disposed of accordingly.
