In compliance to the Order of this Court dated 17-02-2023, the State-Respondents have filed a Compliance Report dated 20-02-2023.

Learned Government Advocate submits that out of the 57 aggrieved Petitioners from Gnathang Machong Constituency, on physical verification by the concerned officials, 44 (forty four) of them have been found to be eligible for the relief claimed under the Housing Scheme, being Sikkim Garib Aawas Yojana (SGAY). 13 applicants were found to be ineligible as they failed to fulfill the criteria laid down under the Scheme. From the 13 persons, one has since passed away, hence there are now 12 ineligible Petitioners.

Considered submissions.

On perusing the Order of this Court dated 17-11-2022, it was inter alia submitted by Learned Advocate General that the applicants be directed to submit individual applications putting forth their grievances with full particulars to enable the Committee to examine the grievances in light of the terms of reference of the Notification bearing O.O. No.17/RDD, dated 14-11-2022, issued by the Respondent No.2, Rural Development Department, Government of Sikkim. Learned Counsel for the Petitioners had undertaken to take steps.

No steps have been taken by the Petitioners in terms of the above Order and Learned Counsel for the Petitioners admits this position.

In the circumstances, the State-Respondents shall take necessary steps in terms of the Scheme, viz; Sikkim Garib Aawas Yojana for the 44 Petitioners found eligible by the concerned officials.

Nothing further remains for adjudication in the instant matter.

WP(C) No.30 of 2020 stands disposed of accordingly.

Pending applications, if any, also stand disposed of.
