Judgment
Mohan Shantanagoudar, J.—Since the order to be passed in this writ petition does not affect the Respondent, notice to Respondent is dispensed with.
This writ petition is filed praying for a direction to Karnataka Appellate Tribunal (Co-op), Bangalore to hear Appeal No. 236/2007, at the earliest.
The records reveal that the departmental enquiry was conducted against the Petitioner on certain charges in the year 2004. Enquiry was concluded on 20.6.2005, and the report was against the Petitioner. Consequently, the order of dismissal was passed against the Petitioner on 28.10.2005. Petitioner raised the dispute before the Registrar of Co-operative Societies. The Registrar passed the order dated 28.9.2006, quashing the order of dismissal. Questioning the order of the Registrar, the Respondent-management filed an appeal before the Karnataka Appellate Tribunal in Appeal No. 236/2007. Since the said appeal is not disposed of till this day, this writ petition is filed.
As Appeal No. 236/2007 is pending since 2007 same needs to be decided at an early date, inasmuch as the delay in disposal of the appeal may harass the Petitioner.
Accordingly, the Karnataka Appellate Tribunal (Co-op) is directed to dispose of Appeal No. 236/2007, on merits and in accordance with law as early as possible but not later than the outer limit of four months from the date of receipt of this order, if not already decided.
Writ petition is disposed of accordingly.
