Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The lawyers have no objection with regard

to the proceeding, which has been held through Video Conferencing today at 11.00 a.m. They have no complain in respect to the audio and video

clarity and quality.

This case was listed/supposed to be listed before the Lawazima Board for passing an order in respect of the defects, pointed out by the Office.

Considering the pandemic situation where the Court has minimized the footfall of the lawyers and their Clerks in the Court, this Court felt proper to

get all the cases listed before this Court so that the defects can be looked into at this stage only. Thus, this case is listed today before this Court

directly.

Counsel for the petitioner submits that the defects have already been removed. Office to check the same.

The petitioner has confined his prayer to the quashing of the First Information Report (Kadma Police Station Case No.230 of 2019 registered for

offences under Sections 323, 376, 504, 506 of the Indian Penal Code) only.

There is an allegation against the petitioner that the petitioner has cheated the informant on the false pretext of marriage. It is further alleged that

the petitioner is now threatening the informant of severe consequences as she is pressurizing the petitioner to perform marriage. There is also an

allegation that the petitioner has taken money from the informant.

Considering the allegations levelled in the written report, I find that this is not a case where the First Information Report needs to be quashed. The

police is directed to investigate the case and file report in terms of Section 173 of the Code of Criminal Procedure on conclusion of the investigation.

This criminal miscellaneous petition is, thus, disposed of.
