The petitioner, who is stated to be the Secretary of a society by name "Thathwamasee Ayyappa Seva Samithi" registered under the Travancore-Cochin Literary, Scientific and Charitable Societies Registration Act, 1955, has filed this writ petition under Article 226 of the Constitution of India, seeking a writ of mandamus commanding respondents 1 to 3 to consider Ext.P1 representation and take a decision for granting permission to Thathwamasee Ayyappa Seva Samithi to provide shelter and other facilities for Sabarimala pilgrims in the premises of Subramaniya Swami Temple, Harippad.
The petitioner has filed this writ petition in his individual capacity. Any resolution taken by Thathwamasee Ayyappa Seva Samithi, authorising the petitioner to file a writ petition before this Court seeking the aforesaid relief is not placed on record. There is also no averment to that effect in the writ petition.
After arguing for sometime, the learned counsel for the petitioner seeks permission to withdraw this writ petition, without prejudice to the right of the Samithi to file a fresh writ petition in a proper manner.
Recording the above submission made by the learned counsel for the petitioner, this writ petition is dismissed as withdrawn, without prejudice to the legal right, if any, of the Samithi to seek such a relief.
