The petitioners have filed this writ petition under Article 226 of the Constitution of India, seeking a writ of mandamus commanding the respondents to convene a fresh general body meeting of the devotees of Puranattukara Maha Vishnu Temple managed by Poonkunnam Devaswom under Cochin Devaswom Board and constitute a proper Temple Advisory Committee as per Ext.P1 by-law. The petitioners have also sought for a writ of mandamus commanding the respondents to stay Ext.P5 order No.A5.11035/2022 dated 10.11.2022.
The document marked as Ext.P5 is a copy of the order dated 10.11.2022 of the 1st respondent Cochin Devaswom Board, whereby the Temple Advisory Committee
of Puranattukara Maha Vishnu Temple, Poonkunnam Devaswom, Thrissur is reconstituted by nomination. Ext.P5 order is not under challenge in this writ petition by seeking appropriate relief. None of the members of the re-constituted Temple Advisory Committee are not made parties.
The learned Standing Counsel for Cochin Devaswom Board would submit that the document marked as Ext.P5 order is incomplete. The said order consists of two pages. The learned Standing Counsel would fairly submit that he shall hand over a copy of that order to the learned counsel for the petitioners.
The learned counsel for the petitioners seeks permission to withdraw this writ petition, without prejudice to the right of the petitioners to file a fresh writ petition with proper parties, pleadings and reliefs.
Based on the aforesaid submission made by the learned counsel for the petitioners, this writ petition is dismissed as withdrawn, without prejudice to the aforesaid right of the petitioners.
