Heard learned counsel for the applicant.
The learned counsel for the applicant submits that the present Original Application has been filed by the applicant under Section 19 of the AT Act, 1985, to challenge the order dated 17.06.2020 (Annexure A-1) vide which provisional pension has been sanctioned to the applicant.
Learned counsel for the applicant submits that there is no legal impediment to sanction the regular pension to the applicant. However, in spite of his representation dated 27.07.2007 (Annexure A-5) to the respondent no.2 followed by another representation dated 21.08.2020 (Annexure A-6) to the respondents no.2, the grievance of the applicant has not been redressed till date.
Issue notice. Ms. Esha Mazumdar, learned counsel for the respondents, who appears on advance service, accepts notice.
At this stage, Shri C Raja Ram, learned counsel for the applicant submits that the applicant shall be satisfied if the present OA is disposed of at this stage with directions to the respondents to consider the applicant's aforesaid pending representations and to dispose of the same in a time bound manner.
We are of the considered view that if such a request of the learned counsel for the applicant is accepted, no prejudice is likely to be caused to the respondents.
In view of the aforesaid, without going into the merit of the claim of the applicant, the present OA is disposed of with direction to the respondents to consider the applicant's aforesaid representations (Annexure A-5 & A-6) and to dispose of the same by passing a reasoned and speaking order as expeditiously as possible and in any case within eight weeks from the date of receipt of a copy of this Order.
The present OA is disposed of in the aforesaid terms. No order as to costs.
