This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused seeking to grant anticipatory

bail in the event of his arrest in connection with Crime No.97 of 2020 on the file of Nawabpet Police Station, Mahabubnagar District, registered for

the offences punishable under Sections 498-A and 306 IPC.

Heard learned counsel appearing for the petitioner/accused, learned Assistant Public Prosecutor appearing for the respondent-State and perused

the record.

The prosecution case is that the marriage of the daughter of de-facto complainant was performed with the petitioner/accused at about 10 years

back and they blessed with one female child, thereafter, the petitioner started harassing her daughter mentally and physically and that on 23.08.2020,

she committed suicide by consuming poison and died in the hospital on 28.08.2020.

Learned counsel for the petitioner/accused submits that the petitioner is innocent of the alleged offences and he never harassed the deceased. He

further submits that the petitioner has to take care of his female child, aged 8 years old, as there is no other person to look after his child. He also

submits that the petitioner is a law abiding citizen and he is ready to abide by any condition that may be imposed by this Court in the event of his

enlargement on anticipatory bail.

Learned Assistant Public Prosecutor vehemently opposed to grant anticipatory bail to the petitioner.

This is the second application for anticipatory bail filed by petitioner. Earlier application for anticipatory bail was dismissed as withdrawn by order

dated 02.12.2020 in Crl.P.No.6231 of 2020.

As seen from the material papers submitted by the prosecution, there are specific allegations against the petitioner that since one year from the date

of death of the deceased, the petitioner used to harass her physically and mentally and that when the deceased informed to her parents, they used to

console and send her to lead happy marital life. However, on 23.08.2020, the deceased and the petitioner went to their cotton fields to do some

agricultural work, where the petitioner abused her physically and mentally, for which she consumed pesticide, and immediately she was shifted to the

hospital, where she died after some time. Thus, looking into the nature of allegations leveled against the petitioner, I am not inclined to grant

anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail is rejected. However, the petitioner/accused is directed to surrender

before the Court concerned within 15 days from today and on such surrender and on filing an application for regular bail, the Court concerned shall

consider the same in accordance with law.

With the above direction, the Criminal Petition is dismissed.

Miscellaneous applications, if any pending in this criminal petition, shall stand dismissed.
