By way of these petitions, common order dated 09.12.2009 passed by Additional Sessions Judge (Fast Track) No.4, Jaipur City, Jaipur in context of

Criminal Revision Nos.379/2009 (821/2009) and 380/2009 (679/2009) has been assailed, whereby order passed by trial court for taking cognizance and

issuance of process against accused respondent(s) has been remitted back to redecide by the revisional court, both the revisions have arisen out of

similar order, so are being decided together by a single order.

In nutshell, a complaint was preferred under the

provisions of Section 156 sub-clause (3) of CrPC by complainant father-in-law of deceased Smt. Rinku Sharma, which was sent by the trial court for

investigation, the investigation was culminated in F.R, and learned court below after hearing complainantprotester having been convinced on the basis

of prima facie evidence, took cognizance against accused Deependra Singh, Rajendra Prasad, Smt. Kamlawati Sharma, Kamal Kumar Sharma and

Smt. Kavita Sharma for the offences punishable under Sections 302, 201 read with 120-B of IPC and summoned the accused persons through bailable

warrants.

Aggrieved, Deependra Singh and Rajendra Prasad &

others preferred two respective revisions against the order of cognizance and revisional court while quashing the cognizance remitted the matter to the

trial for re-consideration.

Heard rival submissions, learned counsel for the petitioner has contended that unnatural death of deceased Smt. Rinku Sharma has occurred in the

premises of her father and the accused persons have failed to discharge burden saddled under Section 106 of the Evidence Act, autopsy report

evidently discloses that hyoid bone of the deceased was not found broken nor the cartilage rings were impacted, which is unnatural in case of death by

hanging, had there been death by suicidal hanging, then the cartilage ring and the hyoid bone would have certainly been affected, viscera report has

disclosed that Diazepam sedative was administered to the deceased, referring testimony of Dr. Suman Dutta learned counsel has urged that Doctor

has opined that after administration of sedative Diazepam, victim could not have been able to hang herself due to insobriety, so theory of suicide by

hanging is improbable, scene of the incident was also intermeddled with and was deliberately altered, which has got serious repercussions on the

fairness of the investigation.

It has further been added that “prima facie†evidence is enough to formulate opinion for taking cognizance, which has rightly been determined by

the trial court but ignoring all the incriminatory factual aspects, revisional court has set aside the order of trial court by remitting the matter for decision

afresh, which is not sustainable under the eye of law and deserves to be quashed. Relying upon the following authorities : Anil Saran v. State of

Bihar & Anr 1996 Cri.L.J. 408, Ajay Mehra & Anr v. Durgesh Babu & Ors 2001 (1) Supreme (Cr.) 606, Bhushan Kumar & Anr v. State (NCT of

Delhi) & Anr JT 2012 (4) SC 127, Baikunth Singh v. State of Bihar & Ors JT 2009 (1) SC 146, Jagdish Ram v. State of Rajasthan & Anr JT 2004 (3)

SC 202, Dy Chief Controller of Imports & Exports v. Roshanlal Agarwal & Ors JT 2003(2) SC 370, Fakhruddin Ahmad v. State of Uttaranchal &

Anr JT 2008 (10) SC 240, Nathi Lal & Ors v. State of U.P. & Anr 1990 (Supp) SCC 145, Mitthulal & Anr v. The State of Madhya Pradesh AIR

1975 SC 149, and Harishchandra Prasad Mani & Ors v. State of Jharkhand & Anr JT 2007 (3) SC 229, it has been further urged that the finding of

revisional court is not sustainable, so the petition be allowed and order dated 25.4.2009 passed by trial court be restored.

Learned Public Prosecutor has contended that the order passed by learned trial court is correct and does not need to be interfered with. Learned

counsel for the other respondents have contended that there is no wrong in the findings of revisional court and revisional court has given a chance to

the court of JM No.12, Jaipur City, Jaipur to re-look into the evidence and pass order afresh, which won’t affect veracity, hence petition lacks

merit, so it be dismissed.

Having heard both the side a circumspect perusal was given to the material available on the record, it emerges that in support of protest petition,

complainant Dinesh Babu Dubey, complainant-father-in-law (sasur) of deceased Smt. Rinku Sharma has produced several witnessesÂ. PW1 Sapna

Bansal, a neighbour of deceased resident of Swarn Path, Mansarovar, Jaipur, has stated that in 2005 a boy and a girl had rented house of Dinesh

Kumar, name of the girl was Rinku and name of the boy was Deependra, she has further stated that she had talking terms with Rinku, who was

engaged in trade of medicines, Smt. Rinku had apprised her that Deependra was her husband, they had resided there for 2½ months on rent and in

January 2006 they vacated the said premises, she has also stated that she can very well recognize Deependra and Rinku. PW2 Rajendra Kumar

Prajapati, a shopkeeper has stated that Smt. Rinku Sharma used to buy goods from his shop, Deependra who used to visit her was accustomed of

buying Bidi, Gutkha, Cigarette from his shop on credit borrowing, amount of ₹ 200-250/- had became due against him, so he demanded it from

Deependra. Deependra went away and informed Smt. Rinku Sharma that the shopkeeper was demanding money.Â

Rinku, Deependra and Sumit came to his shop and Smt. Rinku retorted why shopkeeper was demanding due money from Deependra, she will pay for

him. Sumit asked Smt. Rinku wherefore she was intermeddling in the affairs of Deependra’s due, then Smt. Rinku Sharma asked her husband

Sumit to be quite and she was to pay for Deependra’s due and an altercation had taken place between Sumit and Rinku on this count at his shop,

at that time Smt. Rinku Sharma paid borrowing cash qua Deependra.

Witness Vandana (PW3) has stated that Smt. Rinku Sharma had rented a house at Firozabad near her house, where she had introduced Deependra

as her cousin (bua’s son). Similar statement has been rendered by PW4 Renu. Complainant Dinesh Babu has also been examined and he has

narrated incriminatory against the accused persons.

Apex court in B. Jagdish & Anr v. State of Andhra Pradesh & Anr (2009) 1 SCC 681, has held that “material brought on record by complainant,

even if given face value and taken to be correct in its entirety, cannot be said as disclosing no offenceâ€. In Arun Bhandari v. State of U.P. (2013)

2 SCC 801, Apex court has observed : “Neither the FIR nor the protest petition was mala fide, frivolous or vexatious - Not a case where there is

no substance in the complaint â€" The final report of the investigation officer and the entire case diary prima facie makes out a case against the

husband and the wifeâ€​.

Perusal of record reflects that testimony of Dr. Suman Dutta, who has been examined on 2.1.2009 discloses that he had conducted autopsy on the

body of deceased Smt. Rinku Sharma, daughter of Shri Rajendra Kumar Sharma wife of Sumit Dubey on 14.12.2006, she was brought dead in the

hospital, in crossexamination she has specifically mentioned that hyoid bone and cartilage were intact and ring of trachea was also intact, there was no

bone fracture and no dislocation was found in the neck bone, opinion regarding cause of death was kept in abeyance till receipt of FSL report, after

receipt of FSL report opinion pertaining to cause of death was given that deceased had consumed Diazepam prior to her death and cause of death

was ante mortem hanging, it has also been stated that consumed quantity or dosage of Diazepam cannot be opined, contents of Diazepam were found

in stomach, small intestine, liver, spleen, kidney and blood. FSL report dated 22.12.2006 has got mentioning of result of chemical examination,

disclosing that positive test for presence of Diazepam, tranquilizing drug was found in stomach, small intestine, liver, spleen, kidney and blood.

Learned trial court while passing impugned order with respect to taking of cognizance has dealt the material thoroughly and the trial court has

observed :-

It emerges from the evidence produced in support of protest petition and material available on the record that deceased Smt. Rinku Sharma was

habitual of living with Deependra and use to incur his expenditures and paying for his borrowings, deceased did introduce Deependra with others

distinctively sometime as her husband, some time as her cousin, complainant had found deceased Smt. Rinku living with Deependra quibbling with her,

accused persons have not come forward even to lodge FIR. Entire afore-discussed evidence prima facie brings out a case necessitating

cognizance.

Thus learned trial court has correctly determined decision to take cognizance against the accused persons on the basis of prima facie evidence and

revisional court has fallen into error, while quashing the order impugned and remitting the matter for re-consideration.

In the result, both the petition, S.B. Criminal Misc. Petition Nos.119/2010 and 124/2010 are allowed and order impugned dated 09.12.2009 passed by

Additional Sessions Judge (Fast Track) No.4, Jaipur City, Jaipur is quashed and set aside, let record of the court below be transmitted back promptly,

learned trial court is directed to proceed with the trial expeditiously.
