By way of instant petition a challenge has been made qua the order passed by Additional Sessions Judge, Jhalawar passed in Criminal Revision

Petition No. 1/2015, whereby learned Revisional Court has confirmed the order passed by Judicial Magistrate First Class, Jhalawar in connection with

FR No. 7/2014, which was filed with reference to FIR No. 148/2013 lodged by Smt. Manju wife of Ram lal Lodha on 11.12.2013 against respondent

No. 2 Girriraj.

In brief a FIR was lodged by Smt. Manju wife of Shri Ram Lal Lodha against her landlord, which was presented under the provisions of Section

156 (3) of Cr.P.C. and was ordered by the area Magistrate to be registered, which was later registered as FIR No. 148/13 for the offence punishable

under Sections 452, 376 of IPC.

Heard and perused the record and examined the order impugned. Scrutiny of both the orders does not reveal any infirmity.

Learned trial court, while dealing with the protest petition, preferred challenging the final report, has dealt with the evidence and factual aspect

thoroughly and in para 4 it has been observed:-

Learned revisional court, while deciding criminal revision No. 1/2015 has also examined the evidence collected by the Investigating Officer and has

Factual aspect of the investigation, which has been dealt with by the court below does reveal that a verbal altercation had taken place between

respondent landlord and petitioner tenant, on the pretext of arrears of the rent and both the witnesses who averred themselves to be the eye-witness,

have subsequently categorically stated that they did not witness any incident and their signatures were taken coercively by the police. Respondent

Girriraj is admittedly an individual of advanced senile age, who two has not been found “potent†by a Board of medical experts and Medical

Board has remained of the opinion that Girriraj was not found capable to cohabit.

Both the courts below have observed and scrutinized evidence available on the record thoroughly and has dealt with it without any infirmity.

For the reasons discussed and deliberated, there appears no ground to intermeddle with the findings of the courts below.

 Feminine modesty is pious and it deserves to be honoured and adorned, which ought not to be allured to be a cause of vendetta.Â

Upon considering in entirety, no infirmity or perversity is found in the orders passed by both the courts below. Hence, petition being bereft of merit is

dismissed.
