Learned Senior Additional Advocate General has handed over a copy of the instructions, which stand imparted to him by the Director, Medical Education & Research Himachal Pradesh and relevant part of the instructions, dealing with the present Writ Petition reads as under:
"In the light of the judgment, the services rendered by Dr. Anita Negi M.O. (Specialist) in IGMC, Shimla after Post graduation can be considered as field posting for her appointment as Senior Resident in the department of Pathology subject to availability of vacancy in Govt. Medical Colleges as also in order of her merit".
On the strength of instructions, so imparted to learned Senior Additional Advocate General, he submits that the petition can be disposed of in the light of said instructions.
Learned Senior Counsel appearing for the petitioner has perused the instructions and he concurs with the submissions so made by learned Senior Additional Advocate General.
Accordingly, this Writ Petition is disposed of, by directing the State to consider the petitioner for appointment against the post of Senior Resident in the Department of Pathology and offer her posting, in case on the basis of her merit, as obtained in the selection process undertaken by the State, in pursuance to the interim order passed by this Court, dated 20.08.2019, she is found eligible for appointment.
Needful shall positively be done within a period of one week from today. State shall also be at liberty to proceed with the filling up posts of Senior Residents in the speciality concerned, qua which process subsequently has been undertaken by the State. Pending Miscellaneous applications, if any, also disposed of.
