These are two writ petitions whereby the challenge is common order of transfer dated 05.02.2019.
The two petitioners are Husband and Wife and both are working as Professor at Chhattisgarh Institute of Medical Science, Bilaspur. Both have
been transferred to Government Medical College, Ambikapur.
The limited grievance which the petitioners have raised through these writ petitions are that, the transfer has been made during mid session
particularly when the examination of their daughter is undergoing and therefore they be protected till the academic session is over. It has been pleaded
by the petitioners that their daughter is a student of Class-IXth and her examination is scheduled to be held later in this month and would continue up
till March, 2019, and therefore they have prayed that the order of transfer of both the petitioners be kept in abeyance till the academic session or the
examination of their daughter is over.
The said request of the petitioners seem to be fair and reasonable prayer on their part. Therefore, considering the limited request that they have
made, this court is of the opinion that ends of justice would meet if the writ petitions are disposed of with a direction to the respondents No.2&3 to
ensure that the petitioners are not relieved from the present place of posting i.e. CIMS, Bilaspur, till 15th April and the respondents would be at liberty
to relieve the petitioners, if need so arises, only after 15th April, 2019.
Both the writ petitions accordingly stand allowed and disposed of.
