Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Basia P.S. Case No. 78 of 2023, registered under Sections 379, 411, 34 of I.P.C., pending in the Court of learned A.C.J.M., Gumla.

Learned counsel for the petitioners submits that the petitioner no. 1 namely, Guddu Sahu has been arrested during pendency of this petition. He submits that he is not pressing the petition on behalf of petitioner no.1.

In view of above, anticipatory bail petition on behalf of petitioner no.1 namely, Guddu Sahu is dismissed as not pressed.

So far prayer for anticipatory bail on behalf of petitioner no.2 is concerned, learned counsel for the petitioners submits that in the confessional statement of apprehended accused the name of the petitioner no. 2 has come. He submits that motorcycle in question was recovered from the house of Santosh Sahu.

Learned counsels for the State opposes the prayer for anticipatory bail on the ground that the name of the petitioner has come in the confessional statement.

Considering that motorcycle in question was recovered from the house of Santosh Sahu, I am inclined to grant anticipatory bail to the petitioner no. 2. Accordingly, the petitioner no. 2 namely, Anmol Sahu, is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner no. 2 shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned A.C.J.M., Gumla, in connection with Basia P.S. Case No. 78 of 2023, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure and the petitioner no. 2 will not change his mobile number which is indicated in his Aadhar.
