Gurdas Ram vs State of H.P. and another

Justice Kurian Joseph, C.J.—The writ petition is filed with the following prayer:

That a writ in the nature of Mandamus may kindly be issued directing the respondents to consider the petitioner for his conversion into daily waged chowkidars w.e.f. the date they have completed 10 years of service as part time chowkidars, as per instructions dated 27.2.2004 and instructions dated 13.10.2009 issued by the Chief Secretary to the Govt. of H.P., with all consequential benefits like arrears of the wages and other from the date of issuing of notification in the year 2004.

The petitioners are working as part time Revenue Chowkidars. The State Government, in its wisdom, has framed a scheme to grant daily wager status to the part time workers on 27.2.2004. The Government has framed subsequent policy as well.

There will be a direction to the second respondent/competent authority to look into the matter and take appropriate action in the case of the petitioners, on verification of facts, in the light of the policy, within a period of four months from the date of production of a copy of this judgment alongwith a copy of the writ petition by the petitioners before the second respondent/competent authority.

The writ petition is disposed of, so also the pending application(s), if any.
