Applicant Lakshmi Alias Lichchhma is in judicial custody in FIR No.673 of 2023, under Section 379 and 411 IPC , Police Station- Kotwali Haridwar, District-Haridwar. She has sought her release on bail.

Heard learned counsel for the parties and perused the record.

According to the FIR, on 01.10.2023, when the family of the informant was travelling in an auto-rickshaw, their bag, containing jewellery, was stolen. Record reveals that all the articles were recovered 20 days after the date of incident.

It is the case of the applicant that she is an old lady; she has not committed any offence; there is no independent witness; the FIR is delayed by four days; articles were never identified; there is no previous criminal history.

Learned State Counsel would submit that the bail rejection order does not reveal any previous conviction of the applicant.

Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.

The bail application is allowed.

Let the applicant be released on bail, on her executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.

Let a certified copy of this order be supplied to learned counsel for the parties, today itself, on payment of usual charges.
