M/S Akash Electro Tek Engineers Pvt. Ltd. vs Northen Railways

The present petition has been filed under Section 29A(5) of the Arbitration and Conciliation Act, 1996^{11.“the Act” hereinafter} seeking extension of the mandate of the learned Sole Arbitrator by a further period of six months with effect from 30.07.2026.

The disputes between the parties were referred to arbitration by order dated 18.02.2020 passed by this Court in ARB.P. No. 636/2019.

It is to be noted that the mandate of the learned Sole Arbitrator has already been extended by this Court vide orders dated 13.05.2024 and 30.01.2026.

Issue notice

Notice is accepted by Ms. Chetna Rai on behalf of the Respondent.

Learned Counsel for the Respondent submits that she has no objection to the extension of the mandate.

This Court is empowered under Section 29A(5) of the Act to extend the mandate of the Arbitral Tribunal upon sufficient cause being shown.

In view of the submissions made and reasons stated in the petition, this Court is satisfied that sufficient cause has been made out for extension of the mandate.

Accordingly, the mandate of the learned Sole Arbitrator is extended by a further period of six months with effect from 30.07.2026. The period till today shall also stand regularized.

The learned Sole Arbitrator shall endeavor to conclude the proceedings and render the award within the extended period.

The petition is disposed of in the above terms.
