The instant petition has been filed on behalf of the petitioner seeking issuance of directions to the official respondents to protect his life, liberty and property, as he apprehends threat to the same at the hands of private respondents No.4 to 6.

While respondent No.4, namely, Rekha Yadav is daughter-in-law of petitioner, respondents No.5 and 6 are parents of petitioner’s daughter-in-law (Rekha Yadav).

Learned counsel for the petitioner submits that matrimonial relations between petitioner’s son and his wife Rekha Yadav (respondent No.4) are strained to some extent. It has been submitted that petitioner’s son is a Neuro Therapist and is residing out of Fazilka and comes there occasionally. Learned counsel further submits that since even wife of the petitioner has expired, he apprehends threat to his life, liberty as well as his property as his daughter-in-law is making attempts to forcibly grab his house.

This Court has considered the aforesaid submissions.

It appears to be a case arising out of some straining of matrimonial relationship of petitioner’s son with his wife Rekha Yadav (respondent No.4). Though this Court would not like to comment anything as regards the threat perception of the petitioner, but having regard to the age of the petitioner, respondent No.3 – SHO, Police Station City-2, Abohar is directed that in case the petitioner is ever required to be associated with any kind of inquiry arising out of matrimonial dispute of petitioner’s son in the capacity of a witness, then a prior notice in terms of Section 160 Cr.P.C. shall be furnished to him. In case, he sought to be arrested on the basis of some allegations arising out of such matrimonial dispute, then a prior notice of 10 days’ will be afforded to him.

Petition stands disposed of accordingly.
