This is a petition under Section 11(6) of the Arbitration & Conciliation Act, 1996 ('Act') seeking appointment of a Sole Arbitrator to adjudicate the disputes between the parties.
Learned counsel for the respondent submits that in view of the judgment of the Supreme Court in Perkins Eastman Architects DPC & Anr. vs. HSCC (India) Ltd. 2019 SCC Online SC 1517, the respondent has no objection to the Arbitrator being appointed by this Court. He, however, submits that there is a panel prepared by the respondent/DMRC which contains the names of former Judges of various High Courts including the High Court of Delhi. Mr. Johri has shared the panel with the learned counsel for the petitioner, who has no objection to the Sole Arbitrator being appointed from amongst the panel maintained by the DMRC.
With the consent of the parties, Mr. Justice Vinod Goel, former Judge of this Court is appointed as a Sole Arbitrator to adjudicate the disputes between the parties.
