Ms. Lalita Kumari and Another vs State of Himachal Pradesh and Others

Rajiv Sharma, J.—Petitioners were appointed as Language Teachers (Para Teachers) by the Respondent-department in Government Senior Secondary School, Chakloo. They joined their duties on 17.6.2004 and 16.6.2004, respectively. They have obtained their degree/certificate from Hindi Sahitya Samelan Paryag, Allahabad. Their services have been terminated by the Respondent-department since they have obtained the degree/certificate from Hindi Sahitya Samelan Paryag, Allahabad, which is not recognized by the State of Himachal Pradesh for the purpose of public employment.

The question whether the degree issued by Hindi Sahitya Samelan Paryag, Allahabad is recognized or not is no more res integra in view of the judgment rendered by this Court in CWP No. 19 of 2008, tilted as Smt. Shushma Devi v. State of Himachal Pradesh and Ors., decided on 8.7.2009.

Accordingly, there is no merit in the petition and the same is dismissed. There shall, however, be no order as to costs.
