Heard learned Counsel for the petitioner and the

Counsel appearing on behalf of the State.

The father of the petitioner was a peon in Gandhi

Smarak Vidya Mandir Uchha Vidyalaya-Cum-Inter College,

Pachrukhi, Siwan who died in harness on 05th August, 2015. The

petitioner has filed the instant writ application for a direction to the

respondents to consider his case for compassionate appointment on

account of death of the bread earner of the family. According to the

petitioner, the matter is pending before respondent No. 4, the

District Programme Officer, Siwan.

In the matters of compassionate appointment, the

respondents are required to take a final decision at the earliest, so

that the family of the deceased may not disturb financially on

account of the death of the bread earner of the family.

This writ application is, accordingly, disposed of

with a direction to the respondent No. 4, the District Programme

Officer, Siwan to take a final decision in the matter of

compassionate appointment of the petitioner at the earliest,

preferably within a period of three months from the date of

receipt/production of a copy of this order.

Respondent Nos. 3 and 4 are under obligation to

place the case of the petitioner before the appropriate authority

within the aforesaid period, so that necessary order in the matter of

compassionate appointment may be passed and the case of the

petitioner, one way or the other, is finally decided.

With the aforesaid observations, the writ application

stands disposed of.
