Heard.
Learned counsel for the petitioner would draw attention of the Court to the documents-Annexure P/10 dated 9.6.2016 and Annexure P/11 dated 23.6.2016, whereby, the Secretary, Department of School Education, Government of Chhattisgarh has issued instructions to the Director, Public Instructions and the District Education Officer for release of payment of Rs.9,90,000/- to the petitioner, for which, he is entitled as he had performed the work of printing and stationary of the Rajiv Gandhi Shiksha Mission, Block Dabhra, District Janjgir-Champa in the year 2012.
On an earlier occasion, the petitioner has moved WPC No.1566/2018, which was disposed of directing the authorities to consider the petitioner's representation. However, the representation has been disposed of vide Annexure P/1 by the Block Resource Centre Coordinator, Rajiv Gandhi Shiksha Mission, Dabhra saying that it is not possessed of the records of the contract of printing and supply of stationary entered with the petitioner.
In view of the stand taken by the B.R.C., Rajiv Gandhi Shiksha Mission, Block Dabhra and on perusal of the documents-Annexure P/10 and P/11, it appears, the B.R.C., Rajiv Gandhi Shiksha Mission has not decided the representation in a diligent manner.
Let the petitioner move a representation before the Collector District Mission Officer, Rajiv Gandhi Shiksha Mission, District Janjgir-Champa, within 3 weeks from today and thereafter, the said Officer shall consider and decide the petitioner's representation in light of Annexure P/10 & P/11 within next 7 weeks.
If the payment is indisputable but still it is not received in favour of the petitioner and the petitioner is required to move again before this Court, the Rajiv Gandhi Shiksha Mission, Block Dabhra, District Janjgir-Champa may be held liable to pay interest on the said amount to the petitioner @ 18% per annum.
The writ petition is accordingly disposed of.
