Learned counsel for the parties are present.

Learned counsel for the petitioner has relied upon a judgment passed by this court in the case of Nagendra Kerketta and another versus State of Jharkhand and others and other analogous cases reported in 2019 SCC Online Jhar. 1362 decided on 12.09.2019. He submits that the present case is squarely covered by the said judgment.

Learned counsel appearing on behalf of the respondents has submitted that Appeal arising out of the said judgment being L.P.A. No. 75 of 2020 is pending before the Hon’ble Division Bench. The counsels jointly submit that this case may be posted after disposal of L.P.A. No. 75 of 2020.
