Petitioner took an agricultural loan from IDBI Bank, Branch Office, Rudrapur, Udham Singh Nagar in the year 2015. Since petitioner defaulted in repayment of the loan, therefore, the concerned Bank has issued recovery certificate against him. In this writ petition, petitioner has challenged the recovery citation issued by Tehsildar, Rudrapur for recovery of ₹4,33,900/-.
Ms. Manju Bahuguna, learned counsel for the petitioner submits that petitioner is ready and willing to repay the entire loan provided some reasonable time may be given to him for the purpose. He further submits that petitioner has already made representation dated 22.09.2021 to the Branch Manager, IDBI Bank, Branch Rudrapur, District Udham Singh Nagar in which he has prayed that he may be permitted to deposit the loan amount in easy instalments. Learned counsel for the petitioner confines her prayer and submits that the Competent Authority in the Bank be directed to take decision on petitioner's representation.
Having regard to the willingness shown by the petitioner to deposit the entire outstanding loan amount, the writ petition is disposed of with a direction to the Competent Authority in the Bank to take decision on petitioner's representation dated 22.09.2021, as early as possible, but not later than three weeks from the date of receipt of certified copy of this order. It is made clear that petitioner shall deposit a sum of ₹50,000/- with the bank within one week from today to show his bona fide.
Let certified copy of this order be supplied to the petitioner today itself.
