11 paragraphs · 202 wordsPetitioner is seeking anticipatory bail under the provisions of Section 438 Cr.P.C. in FIR No.108 dated 11.05.2018 under Sections 21 (b)/ 61/85 of the
NDPS Act, registered at Police Station Sadar Tohana, District Fatehabad (Haryana).
2.) This Court vide order dated 02.08.2018 had directed the petitioner to join investigation and in the event of arrest by the Investigating Officer,
petitioner was ordered to be released on interim bail on his furnishing bail bonds to the satisfaction of the Investigating Officer.
3.) Learned State counsel, on instructions from SI Ram Kumar submitted that in pursuance to the order dated 02.08.2018, petitioner appeared before
the Investigating Officer and joined the investigation. It is further submitted that petitioner is not required for custodial interrogation in the present case.
4.) In view of these facts and circumstances, without expressing any opinion on the merits of case, the order dated 02.08.2018, granting interim bail to
the petitioner, is hereby made absolute. Petitioner shall remain bound by the conditions as envisaged in Section 438 (2) of Cr.P.C.
5.) The petitioner shall not in any way indulge in any criminal activities and he shall not influence the witnesses or otherwise interfere with the fair
trial.
6.) Petition stands allowed.
