The present civil writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondent authorities to release 100% pension, leave encashment, gratuity, commutation and other retiral benefits together with interest @ 18% per annum within stipulated period.

Learned senior counsel for the respondent at the very outset refers to the order dated 24.04.2023 in which the following order was passed:-

‘Learned Senior counsel for the respondents No.1 to 5 places reliance upon an affidavit dated 26.05.2022 executed by Raj Kumar son of Ram Anjore in the context of receiving the dues of his father after full and final settlement of the claim. The affidavit along with other documents relating to the payment of Rs.2,99,560/- is taken on record, a copy of the same has been handed over to learned counsel for the petitioner.

Learned counsel for the petitioner seeks time to ascertain the veracity of the affidavit filed by the son of the petitioner.

Adjourned to 29.05.2023.’

and submits that the entire claim raised by the petitioners in the present petition has been set aside and the retiral dues have been released in favour of son of the deceased petitioner.

Learned counsel for the petitioner submits that he is satisfied with the statement made by counsel for the respondents and the present petition may be disposed of.

In view of the above, the present civil writ petition is disposed of. However, the petitioner would be at liberty to revive the present petition in case the factual positions as depicted in the order dated 24.04.2023 is not correct.
