Judgment

(Interim Relief Application No. 10460 of 2010)
Heard learned Counsel for the parties and perused the record.
By means of this writ petition, the Petitioners have sought a writ in the nature of mandamus commanding the Respondent No. 3 to refer the matter regarding election conducted on 23-4-2010 of Anjuman Islamia Nainital to Prescribed Authority in accordance with letter dated 22-9-2010 (Annexure-11 to the writ petition).
According to the Petitioners, they are the members of the Respondent No. 4, which is a registered religious society and has been duly registered with the office of the Respondent No. 1. The Petitioners participate in the working of the society and its members. The present election took place on 23-4-2006 wherein 23 members as office bears of the managing committee were to be elected. In all 58 candidates including the Petitioners contested the said election.
The grievance of the Petitioners is that the Chief Election Commissioner in collusion of some members of the society nominated some assistants for counting of votes without information to the Petitioners and surreptitiously declared the result of the election. According to the Petitioners, they have made an application u/s 25 of the Societies Registration Act to the Registrar concerned (Annexure-3 to the petition), but the same is still pending for disposal.
During the course of arguments, learned Counsel for the Petitioners has urged that the ends of justice would be served if the Respondent No. 2-Registrar concerned is directed to decide the application of the Petitioners (Annexure-3) within a time bound period and the writ petition may be disposed of accordingly.
In the above facts and circumstances, the Registrar, Firms Societies and Chits, Haldwani is directed to decide the application of the Petitioners, which was moved u/s 25 of the Societies Registration Act. (Annexure-3 to the petition) in accordance with law by a speaking and reasoned order within a period of four weeks from the date of production of a certified copy of this order.
With the above observations, the writ petition is disposed of finally.
