Judgment
The petitioner is the registered owner of Ext.P1 regular permit
in respect of stage carriage bearing No.KL-11-U-9954. The petitioner
has submitted Ext.P4 application seeking replacement of the vehicle
with a lesser model vehicle bearing No.KL-10-T-9649, which is
pending consideration and seeks a direction for early consideration
of the same.
Having heard the learned counsel for the petitioner and the
learned Senior Government Pleader, there will be a direction to the
respondent to consider Ext.P4 in accordance with law. However, I
makes it clear that the respondent will be at liberty to refer the
matter to the concerned statutory authority, if in any case it
requires so. A decision shall be taken within a period of one month
from the date of receipt of a copy of this judgment. The road
worthiness and viability of the vehicle shall be the consideration
rather than the model of the vehicle.
This writ petition is disposed of accordingly.
