Since these two bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties.
These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Khuntuni PS Case No.161 of 2024 corresponding to CT Case No.499(A) of 2024 pending in the file of learned SDJM, Athagarh, for commission of offences punishable U/Ss.325/ 303(2)/ 317(2)/ 3(5) of BNS and Section 11(1)(a)(d)(e) of Prevention of Cruelty to Animals Act, on the main allegation of unauthorizedly transporting Beef in a six wheeler Truck bearing Registration No. MH-26BE-9460.
Heard, Mr. Amulya Ratna Panda, learned counsel for the petitioner in BLAPL No. 5877 of 2026; Mr. Kaustuva Mohanty, learned counsel for the Petitioner in BLAPL No. 6531 of 2026 and Mr. T.K. Acharya, learned Additional Public Prosecutor in the matter and perused the record.
After having considered the rival submissions and taking into account the nature and gravity of the offences as alleged against the petitioners vis-à-vis the accusations sought to be brought against them and regard being had to the pre trial detention of the Petitioners in custody since 08.04.2026 with grant of bail to co-accused Sk. Nasraffa @ Sk. Nasurulla @ Suraj in BLAPL No. 8848 of 2025 and taking into account the mode and manner of implication of the present Petitioners and keeping in view the inherent right of the accused to be presumed innocent until proven guilty at the trial, this Court without expressing any view on merits admits each of the petitioners to bail.
Hence, these two bail applications of the petitioners namely Sk. Musaraf Alli (In BLAPL No.5877 of 2026) and Sriman Jatin Kumar @ Jatin Kumar Behera (In BLAPL No.6531 of 2026) stand allowed and each of the petitioners is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty-five Thousand) with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it.
Accordingly, these BLAPLs stand disposed of. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
