This application has been preferred by the (original petitioner) for substituting the witness and consequently his affidavit as examination-in-chief because the earlier witness has already left the services of the original petitioner.
In view of these limited submissions and having heard the counsel for the respondent, this M.A. is allowed. Original petitioner is permitted to file an affidavit of new witness on behalf of the petitioner which will be examination-in-chief of that witness and the said witness shall be presented by the original petitioner for cross examination as and when the respondent so demands.
With this observation this M.A. is hereby allowed and disposed of.
