Sunita Rani And Another vs State Of Punjab And Others

Prayer in this petition, filed under Article 226 of the Constitution of India, is for issuance of directions to officials respondents to protect the life and liberty of the petitioners at the hands of respondent Nos. 4 to 6.

As per averments made in the petition, petitioner No. 1 Sunita Rani was married to respondent No. 4 Lashman Dass and respondent Nos. 5 and 6 are the parents-in-law of petitioner No. 1.

Learned counsel for the petitioners submits that petitioner No. 1 has left the company of respondent Nos. 4 to 6 on 02.12.2019 and has started living with petitioner No. 2 Sandip Kumar and they are maintaining a live in relationship.

Learned counsel for the petitioners further submits that petitioner No. 1 is having a one and a half year old child, who is in her custody.

It is further submitted that petitioners have given a representation dated 09.12.2019 (Annexure P-3) to Senior Superintendent of Police, Hoshiarpur, in which it is stated that since the husband of petitioner No. 1 is an alcoholic person, therefore, she has left his company as well as company of her in-laws and is living with petitioner No. 2. It is further stated therein that Hoshiarpur police is harassing the petitioners, however, there is nothing on record to suggest that at any stage, the police has approached the petitioners at the behest of respondent Nos. 4 to 6.

Since it is a primary matrimonial dispute between petitioner No. 1 Sunita Rani and respondent No. 4 Lashman Dass, the petitioners have efficacious remedy of approaching the competent Court of law seeking decree of divorce from respondent No. 4.

Considering the fact that a totally vague representation is relied upon by the petitioners, which is not supported by any postal receipt or a receipt from the office of Senior Superintendent of Police, Hoshiarpur, I find no reason to entertain the present petition.

Accordingly, the present petition is dismissed.
